THE SOUTH AFRICAN SCHOOLS ACT 1996

THE CHILD CARE ACT (Replaced by the Children's Act No 38/2005)

To provide for the establishment of children’s courts and the appointment of
commissioners of child welfare; for the protection and welfare of certain children; for
the adoption of children; for the establishment of certain institutions for the
reception of children and for the treatment of children after such reception; and for
contribution by certain persons towards the maintenance of certain children; and to
provide for incidental matters.  The Updated Children's Act can be downloaded from
the links below.  in July 2007 All Child-related Acts are incorporated into the Updated
Children's Act, including international agreement for child support, children's rights to
health and welfare.

Rights in Brief: Defining children’s constitutional right to social services*NEW*
PDF Download - This rights brief defines children’s right to social services – a
right which is currently under discussion in relation to the Children’s Act. The
new legislation focuses on giving effect to three constitutional rights:
children’s right to social services; their right to family care, parental care or
appropriate alternative care; and the right to be protected from all forms of
neglect and abuse. The rights brief therefore outlines the scope and content
of these rights in order to feed into the deliberations on the new law. The
publication is an output of the CI’s Project 28, which aims to define the
scope and content of children’s constitutional rights using jurisprudence,
academic commentary and international law.
